(a) THE DEVICES ARE NOT MEDICAL DEVICES AND ARE NOT GUARANTEED TO DETECT ALL FALLS. IN NO EVENT SHALL DOMALYS BE LIABLE TO THE CLIENT AND/OR RETIREES FOR ANY FAILURE OF THE DEVICES, FOR FAILURE TO DETECT A FALL, LOSS OF PROFITS, USE OR GOODWILL, COSTS OF COVER, OVERHEAD OR DUE TO DELAYS IN SHIPMENT, OR ANY SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING FROM CONTRACT ARISING IN ANY WAY IN CONNECTION WITH THIS AGREEMENT.
(b) IN NO EVENT WILL DOMALYS’ TOTAL AGGREGATE LIABILITY ARISING IN ANY WAY IN CONNECTION WITH THE USAGE OF THE DEVICE, EXCEED THE PRICE OF THE DEVICES WHICH GIVE RISE TO A CLAIM FOR SUCH LIABILITY
(c) THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF DOMALYS HAS BEEN ADVISED OF THE POSSIBILITY OF ANY LOSSES, COSTS OR DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
